“The determining factor is personality”.

Entity possessing rights and duties.

Entity which can sue and can be sued.

Owner of rights and Respondent of rights.

  2. Artificial / Legal Person
  1. Theories of Subjects of IL
  1. Realist Theory

Only States are subjects of IL.

  1. Fictional Theory

Only Individuals are the subjects of IL.

  1. Functional Theory

States, individuals and other entities are subjects of IL.
