Recognition of State
- What is recognition?
Recognition came from ‘recognize’. The literal meaning of recognize to accept the power and authority which is to be claimed by someone.
- What is recognition of State?
Recognition of a state is an act by which another state acknowledges that the political entity possesses the attributes of Statehood.
- Theories of Recognition
- Constitutive Theory
An act of recognition alone which creates statehood.
Poland and Czechoslovakia were recognized by treaty of Versailles 1919.
- Declaratory theory
Statehood of a new government exists prior to recognition and an act of recognition is merely a formal acknowledgement.
Japan was existed before 1854.
Nepolean said, The French Republic no more needs recognition than the sun requires to be recognized.
- The correct view,
Recognition is a political concept, it is given on the basis of state interest. It is governed by the legal principles. It is granted on the economic, strategic and political consideration.
