DESCRIPTION & OBJECTIVES

A criminal offence is a crime against state, society and the public at large. A criminal case pertains to a breach of law for which the remedy lies in arrest, detention, conviction and punishment of the culprit involved in the commission of the crime. The conduct of the trial in a criminal case is different from that of a civil case not only in form and procedure of a trial but also in recording of evidence .in a criminal case state being the custodian of life, honour and property of law-abiding and peace loving citizens is immediately set in motion as soon as some crime is committed. On completion of the investigation, the Challan of a criminal case is sent up to the competent criminal court for recording of Prosecution and Defence evidence including statements of Investigation Officer and other public eye-witnesses on the one hand and the statement of the accused under section 342 Cr.PC on the other.

INTENDED LEARNING OUTCOMES

Upon completion of the Course student should be able to know about:

  • Procedure of a criminal trial , Regular Trial , Summary Trial & Trial in absentia ;
  • Complexities involved in a trial and their legal solutions;
  • Procedure of Judicial Confession ;
  • Procedure recording evidence like Examination in Chief , Cross Examination , Re-examination;
  • Recording of defence evidence like statement of Section 340/342 Cr.pc;
  • Arguments of criminal trial;
  • Acquittal , Conviction , Sentence ;
  • Superdari and disposal of property.

RESEARCH PROJECT

Students were given a research project to submit an F.I.R and it's Challan/Report of 173 Cr.pc of any criminal case which was supervised by the teacher at different stages. 

Moreover , a written assignment minimum of 3000 to 4000 words was assigned to students as Mid-term exam paper. The topics of the assignment were assigned to students in due course. The department has provided the detail guideline with regard to structure and format of the assignment.
